When you commission a work, you aren't just supporting an artist and getting a piece of art you love, you're also contributing to the creation of new art for the world - new joy, new smiles, new moments of contemplation, reflection, delight. Commissions are bigger than us - they are one of life's few precious lifelong investments; like engagement rings and school fees...they mark a time and place in life whilst also bringing a joyful additional dynamic to your daily experiences, forever. What a precious legacy.

2021 Commissions are limited to 10 spots only: nearly half the spots available in previous sell-out years.

Commissions are the ultimate in luxury and exclusivity for your home. They provide an opportunity to collaborate with the artist to create a unique piece that is all about you. Commissions are perfect if you love Claire's style but have yet to see just the right piece, if you missed out on a piece you loved in the past or if you would love to create a special work based on your wedding bouquet, your favourite flowers, a favourite landscape or just a work designed by the artist with you and your favourite colours in mind. Commissions make wonderful anniversary, special birthday or housewarming gifts.

You choose the size that best fits your space and the month in which you would like the work completed. Prints will not be made of your commission - it will be an exclusive piece just for you. All pieces come custom float framed in timber which covers the edges of the canvas but leaves the raw texture of the artwork clearly visible with no glass.

You will be required to fill in a questionnaire to assist in the design process of your commission. You will then be sent a photo of the work when it is in progress at which point you can request small changes be made before the work is completed. Once the work has been completed, you'll be required to approve the work by making the final payment before it is varnished, framed and posted to you. More details can be found in the terms and conditions below.

Completed prices (including the $600 deposit and complimentary shipping) are as follows. All pieces come in custom timber float frames.

61x61cm - $1200 ($600 deposit and $600 final payment)

61x76cm - $1700 ($600 deposit and $1100 final payment)

76x76cm - $2100 ($600 deposit and $1500 final payment)

61x91cm - $2100 ($600 deposit and $1500 final payment)

91x126cm (or similar size square canvas) - $3500 ($600 deposit and $2900 final payment)

All prices are in AUD and include GST.

Please note: Claire can create works that are abstract or of landscapes and flowers in her style, she will not create work in a different style or create portraits of animals or people.

 

The following Terms and Conditions apply for for Commissions.

Commission Agreement. An official copy of this agreement will be sent to you as part of your Commission Questionnaire.

This Agreement (“Agreement”), is entered into at the time of payment of the deposit. It is between Claire Devine (hereby known as "the Artist") and the payer of the deposit ("Client") and shall govern the respective rights of Artist and Client with respect to the artwork described herein.

1. 2021 Commissioned Artworks require a $600 booking deposit with the balance to be paid when artwork is complete. Final payment must be made prior to delivery of the Client's artwork in the month of the Client's choice as per the drop down menu options. The Client's piece may be started much sooner but should be ready to be completed, varnished, framed and posted in the month selected, upon final payment. All due care and attention shall be made to deliver the client's artwork in the month selected. The Client agrees that they shall not hold the Artist or any agent thereof liable for any damages arising from Artist’s failure to complete the Work in a timely manner, regardless of whether such failure was caused by intentional or negligent acts or omissions of the Artist or of any third party.

2. Completed prices (including the $600 deposit and complimentary shipping) are as follows. All pieces come in custom timber float frames.

61x61cm - $1200 ($600 deposit and $600 final payment)

61x76cm - $1700 ($600 deposit and $1100 final payment)

76x76cm - $2100 ($600 deposit and $1500 final payment)

61x91cm - $2100 ($600 deposit and $1500 final payment)

91x126cm (or similar size square canvas) - $3500 ($600 deposit and $2900 final payment)

All prices are in AUD and include GST.

3. Other sizes are available at the Artist's discretion and will be quoted accordingly. Pieces smaller than 61cm are not available for commission. Commissions are charged based on materials and estimated time for completion. For an excellent quality and value result, the Artist will not offer smaller pieces on commission and no exceptions will be made.

4. The Client's deposit covers the initial planning discussion and questionnaire, canvas purchase, fine quality Australian artist paints and the work about half completed for Client's approval before completion. At this checkpoint (called a 'revision') the Client will have the opportunity to suggest minor changes in discussion with the Artist. Only 1 revision is included in the commission price.

5. Final balance of payment from the Client is due prior to delivery upon receipt of photos of the completed work.

6. Upon receipt of the photos of the Client's completed work, the Client may request additional revisions at an additional charge of $200 per revision.

7. Client may terminate this Agreement at any time by sending written notice thereof to Artist via email to salut@thenewdevine.com. Upon such termination, Client agrees to compensate Artist as follows:

(a) Partial Completion. Commissions will not be completely restarted if the Client changes their mind about the composition or major details as per the initial discussion/questionnaire completion. In the event that the Client elect not to complete the commission process, the Client's deposit is non-refundable to compensate the Artist for time and materials. The artwork will not be completed or sent to the Client.


(b) Full Completion. If Artist has completed the finished artwork at the time of cancellation, Client agrees to compensate Artist in full as otherwise provided in this Agreement.

8. Any delinquent payments due shall bear interest at a rate of two and one-half percent (2.5%) per month. Client agrees that it shall bear responsibility for any fees incurred by Artist in enforcing this Agreement, including but not limited to attorneys’ fees and court costs.

9. Once the Client has booked the commission completion month by paying the deposit via this page, the Artist will be in touch to further discuss the brief, size of the work and completion ETA. Client will be required to complete a short questionnaire to help design the commission.

10. The Client agrees that whilst the Client owns the original artwork and has the right to display it, the following rights remain with the artist and are not transferred with the sale of this artwork: the right to modify, transmit, transfer or create derivative works. All copyright remains with the Artist. Photos of the artwork in the Client's home are permissible for the purposes of sharing on social media.

11. The Client agrees to indemnify the Artist against any and all claims and expenses, including but not limited to attorneys’ fees and costs, incurred as a result of the Client's unauthorized use of the Work under this Agreement, including the enforcement of this Agreement by Artist.

12. Artist may use Work in Artist's portfolio (including, but not limited to, any website and social media that displays Artist's works). When asked, Client must properly identify Artist as the creator of Work. Client does not have a proactive duty to display Artist's name together with Work, but Client may not seek to mislead others that Work was created by anyone other than Artist.

13. Client and Artist agree that this Agreement shall not be amended except by a writing executed by both parties, and expressly state that this writing shall constitute a complete expression of the entire agreement between the parties, and that no additional terms exist that are not included herein. To the extent any provision contained in this Agreement shall be found to be void, invalid, or otherwise unenforceable in any way, such invalidity shall not affect the remainder of this Agreement, which shall remain in full force and effect.

By paying your deposit you (the Client) agree to all the above terms and conditions.

Copyright and reproductions

Purchase of any The New Devine original artwork or art product (including reproductions) does not entitle the purchaser to make further copies—the copyright remains with the artist.

Framing

Please note all prints are sold unframed.

We produce our prints to fit standard store-bought frames but we do recommend professional framing to improve the longevity and quality of your piece.

What you pay: As shipping worldwide is free, you pay only the total amount for your artworks as described in the product listing (minus any discount code you may have to apply at checkout.) GST is included in the purchase price listed. If ordering outside of Australia, you may also be responsible for import taxes imposed by your country on your items as they are sent internationally DDU (Delivery Duty Unpaid.) We are not responsible for any additional import taxes or duties you may be required to pay outside of Australia and as such the cost of these is not included in your purchase price from our website.

Unfortunately due to the new VAT requirements of Brexit, we are unable to ship to the UK at this time.
